Are Harley-Davidson Brakes Causing Accidents?

Human hand in a Motorcycle Racing Gloves holds a motorcycle throRecent reports indicate that the National Highway Traffic Safety Administration (NHTSA) will be investigating about 430,000 motorcycles that were manufactured by Harley-Davidson1 between 2008 and 2011. NHTSA has received 43 reports that brakes on the motorcycles from these years have been suddenly failing with no warning for the rider. All of these bikes are equipped with an anti-lock braking system that is intended to help prevent sliding and skidding accidents if a rider has to suddenly hit the brakes.

Unfortunately, this intended safety feature has resulted in reports of at least three crashes, two injured riders, and dozens more near-miss accidents when the brakes unexpectedly failed. If NHTSA finds that the defect likely exists across all of these bikes, the agency may recommend that Harley-Davidson issue a recall to repair or replace the braking system so it is safe for use. This would be the second brake-related recall for the company in two years, since it recalled more than 66.000 bikes in 2014 for brakes that suddenly engaged.2

Have You Been in a Motorcycle Accident Due to Faulty Brakes?

Motorcycle manufacturers are constantly searching for new and innovative ways to improve safety, such as anti-lock brake systems. However, each new component is another opportunity for something to malfunction and put riders in jeopardy of an accident and serious injuries. When riders sustain injuries because a motorcycle part malfunctions, they have the right to hold the manufacturer liable for their losses by filing a claim for products liability.

A motorcycle manufacturer may be negligent if they do the following:

  • Designing defective parts;
  • Assembling parts incorrectly or with inadequate materials;
  • Failing to warn of potential dangers;
  • Failing to issue a recall if it knows of a dangerous defect.

If brakes keep failing, Harley-Davidson may be facing numerous lawsuits filed by injured riders.
