Motorcyclists Are Not the Only Ones Injured in Motorcycle Collisions

Patong, Phuket, Thailand - July 20 : The Motorcycle Crash A CarA motorcycle accident1 that took place near Atlanta this summer reminds us all that riders are not the only ones who sustain injuries when a motorcycle collides with a passenger vehicle. A 26-year-old off-duty police officer was riding his personal motorcycle on a Saturday night when he collided with a Honda Accord trying to make a U-turn. The impact of the crash caused the Accord to flip over and an infant in the backseat of the car did not survive despite emergency transportation to Children’s Healthcare of Atlanta. The officer, who got pinned under the car when it flipped, was pronounced dead at the scene. The father of the infant suffered serious injuries.

Motorcyclists can be negligent and cause accidents

After further investigation, law enforcement officers announced2 that the motorcyclist had been speeding, which was deemed to be the main cause of the collision. The infant’s mother—and the driver of the Accord—told authorities that she did not see the motorcycle coming toward the car and, therefore, had no warning to stop or get out of the way.

This crash demonstrates that drivers of cars or trucks are not always the negligent parties in motorcycle crashes. Often, it is assumed that drivers are not paying close enough attention to notice motorcyclists turning or in neighboring lanes. However, motorcyclists can also be negligent in a number of ways, including:

  • Distracted driving
  • Driving under the influence of drugs or alcohol
  • Speeding or violating other traffic laws
  • Lane-splitting
  • Violating traffic signals
  • Dangerous weaving or lane changes

If a motorcyclist engages in any type of negligent behavior and causes accidents and injuries, they should be held liable for any losses suffered by accident victims. If the motorcyclist does not survive the crash, injured victims may be able to file a claim against the estate or receive an insurance settlement. A skilled personal injury lawyer will be able to advise you of your rights and options.
